The topic of whistleblowing has increasingly come into focus in literature, jurisprudence, and the general public in recent years. This is due to a series of scandals that have shaken Germany, such as the train disaster in Eschede, the expired meat scandal, and the bribery affair at Siemens. Therefore, it is not surprising that there has been much written about whistleblowing lately, from both a legal and a business perspective. However, one of the few legal whistleblowing regulations found in German occupational safety law has not yet been thoroughly examined, namely Section 17 (1) and (2) of the Occupational Safety Act, which is based on Article 11 (1) and (6) of Directive 89/391/EEC. This work aims to address that.
