Product details

In legal and notarial practice, the points of contact with an inheritance community are diverse: on one hand, the client may be part of an inheritance community, and on the other hand, it can act as a contractual partner, creditor, debtor, or as a party in a legal dispute. The completely revised and expanded new edition of the comprehensive handbook thoroughly addresses all questions and problems that may arise in connection with an inheritance community, while also presenting corresponding solutions.

In the general section, alongside classic topics such as the formation, administration, and termination of the inheritance community, the rights of co-heirs among themselves and towards third parties, liability, compensation, litigation, inheritance certificate proceedings, and enforcement are discussed.

In the special section, the legal issues concerning individual co-heirs are first addressed (minors, guardianship, estate administration, estate guardianship). This is followed by legal problems regarding specific estate components (digital inheritance, real estate) and civil law special areas (agricultural inheritance law, corporate law, labor law, tenancy law, insurance law).

Subsequently, legal areas at the intersection of civil law and public law (funeral law, tax law, social law, criminal law, public law) are the focus. The increasing significance of cross-border inheritance cases is covered in a detailed chapter on foreign connections, followed by brief overviews of the most important European countries. Discussions on the professional law of lawyers and notaries conclude the work.

Press review for the 3rd edition ZErb 5/2019: “... an efficient and goal-oriented tool that enables both classic work and thoughtful design for the benefit of the clients.” Prof. Dr. Thomas Gergen, Luxembourg.
