The new Enforcement Form Regulation is coming. On December 16, 2022, the Federal Council approved the abolition of the previous Bailiff Form Regulation and the old Enforcement Form Regulation by the Federal Ministry of Justice. It also approved the new Enforcement Form Regulation (ZVFV), which consolidates, supplements, and further develops the existing regulations and introduces 8 new forms.

The day after the announcement of the new ZVFV, implementation can begin. The new forms can be used immediately; they should be adopted as soon as possible and must be used starting from December 1, 2023.

There is a lot to be done. The merging of the previously completely different form structures means that the new Enforcement Form Regulation brings many innovations in formal application. Additionally, the legal changes in enforcement since 2014 had to be incorporated, and ultimately, the constantly evolving case law must also be taken into account during application.
